Rose Won The Court Battle


June 8, 2021, was a good day for Rose. After hearing all the evidence presented, the court let the Temporary Restraining Order (TRO) against Rose expire at midnight on the same day. The St Lucy’s School asked the court to convert the TRO against Rose to five years. The presiding judge denied the request because St Lucy could not provide any evidence of harassment.

After the hearing, I asked Rose what she would do now. She thanked God for giving her a small victory. Regarding the harassment she received, she quoted me what Jesus said on the cross “Father, forgive them, for they do not know what they are doing.” (Luke 23:24). About the work to feed the hungry, she told me that she has never stopped. With the help of her volunteers, Rose has not stopped working hard to provide for the hungry. She wants to come back to Campbell to continue her work.

For your reference, I provide the original declaration against Rose filed by St Lucy’s School on February 14, 2021, and the response Rose filed in the court on June 8, 2021. You can judge yourself if the TRO filed by the St Lucy’s School has any merit and harassment against the homeless.

It is a surprise to me that someone Rose did not even know could file a temporary restraining order against her without her knowledge and any merit. The judge can quickly approve the TRO, and Rose must relocate without recourse or facing arrest. I wonder, “did the City of Campbell, Campbell Police, one corrupted judge, and St Lucy School conspire against Rose because she is homeless?” I am grateful that at the least one judge is fair and just.

Our society has become increasingly polarized, and the homeless population has grown rapidly. Should we take responsibility for taking care of the poor and the homeless in our community instead of driving them out to other communities?

June 8, 2021,Rose presented her defense, and St Lucy did not offer any new evidence. After examining all evidence presented, Judge Johnson found no evidence supporting the harassment charge. And TPO expired on June 8, 2021.
